Hyderabad.15.09.2024: Justice K. Sujana from the Telangana High Court has stopped the state government and HYDRA commissioner A.V. Ranganath from arresting K. Srinivasulu, an assistant director in Medchal district’s survey and land records department, and another employee, Phool Singh.
Both officials are facing FIRs filed by Cyberabad police following a complaint from HYDRA.
The judge noted that the complaint did not have enough evidence to support the serious charges under Section 316(5) of the Bharatiya Nyaya Sanhita (BNS), which deals with criminal breach of trust. This law can lead to severe penalties, including life imprisonment or up to ten years in prison, plus a fine.
The judge mentioned that the other charges are less serious and can be handled under Section 41-A of the CrPC. Therefore, the judge has asked the authorities to call the accused, take their statements, and instruct them to appear before the authorities.
The officials are accused of allowing illegal constructions in floodplains and buffer zones.
